These terms are the agreement between you and us for playing Glitch by WordJax, in the iPhone and Android app and on the website at wordjax.com/glitch. By playing, you agree to them. Our privacy policy explains what we do with your information.
1. Who you're agreeing with
WordJax is a trade name of Jordan Axelrod, an individual based in Florida, USA. "We" and "us" means him. Contact: jordan@wediorknot.com.
2. Who can play
You need to be at least 13 years old. If you're under the age of majority where you live, please read these terms with a parent or guardian.
3. The game is free
Glitch is free and paid for by ads. There are no purchases and no subscription. Hints, streak repairs and older puzzles may be offered in return for watching a short video ad, which is always your choice. Streaks and stats are there for fun: they aren't money or property, have no cash value, and we may change how they're counted, fix them, or reset them if they were earned by cheating.
4. Playing fair
Glitch has no accounts. Your recovery code in Settings is the only way to move your streak to another phone, so keep it safe and don't share it. Please don't cheat, use bots or scripts, scrape or copy the puzzles, the word lists or the schedule, try to get into parts of the game or our servers that aren't meant for you, or interfere with the game for anyone else.
5. Our game and our content
Glitch, WordJax, the game's design, the puzzles, our selection of words and daily schedule, the artwork, the text and the software belong to us or to the people who licensed them to us. We give you a personal, non-exclusive, non-transferable licence to play for your own non-commercial fun, as long as you follow these terms. Sharing your results with the share button is welcome; republishing the puzzles or their answers in bulk isn't.
6. Ads and other services
Ads come from Google AdMob and its partners. We don't choose individual ads or endorse what they advertise. If you tap an ad, the advertiser's own terms apply to what happens there.
7. Availability, changes and ending things
We'll try to keep the game running with a new daily puzzle every day, but we can't promise it will always be available, on time or free of mistakes. We may change or remove features, puzzles or ad formats, or stop offering the game, and we'll try to give reasonable notice in the app if we close it. You can stop playing whenever you like. We may end your access if you break these terms or the law requires it.
8. The game is provided as it is
The game is provided "as is" and "as available". To the extent the law allows, we give no promises beyond those in these terms, including implied promises of fitness for a particular purpose or that the game will be uninterrupted, error free, or never lose a streak.
9. Limits on our liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost data, lost streaks or lost profits, and our total liability to you for everything related to the game is limited to US$50, because the game is free. Nothing here limits liability that the law says can't be limited, such as for fraud, or for death or personal injury caused by negligence.
10. Law and disputes
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law rules. Please email us first if something's wrong. If we can't sort it out, any court case will be brought in the state or federal courts located in Florida, or in a small claims court if the claim qualifies. If you're a consumer living outside the US, for example in the EEA or the UK, you keep the protection of the mandatory consumer laws where you live and can also bring a claim in your local courts.
11. Terms for the iPhone app
If you got the app from Apple's App Store: these terms are between you and us, not Apple, and we, not Apple, are responsible for the app, its content, its maintenance and support, and any claims about it, including product liability, legal compliance, consumer protection and intellectual property claims. If the app fails to meet a warranty that applies, you may tell Apple, which will refund any purchase price (the app is free); Apple has no other warranty obligation to the extent the law allows. You confirm you're not in a country under a US government embargo or on a US list of prohibited or restricted parties, and you'll follow the App Store's own terms. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Changes, the rest, and contact
We may update these terms; we'll change the date at the top and tell you in the app if a change is significant. These terms and the privacy policy are the whole agreement between us about the game. If part of them is found unenforceable, the rest still applies, and not enforcing something straight away doesn't mean we've given it up.
